Terms and Conditions

PAYMENT

– Classic and Semi-Custom Cakes (online ordering only):

Non-refundable Deposit: $5 for cakes under 9” and $10 for cakes over 9”.
All payments must be paid in full, online, at time of transaction.

– Cancellations have either a 48 hour cancellation policy for 9” or smaller. If 9” or larger, have a 72 hour cancellation policy. If cancellation not requested at time allowance, then customer loses the whole amount of transaction.

Orders are not confirmed until Customer receives an email. If Customer does not receive an email within 24 hours, please contact Lido Bakery to confirm the order. Lido Bakery is not responsible for orders that are incorrectly submitted through the web ordering system.

– Custom Cakes (in house ordering only):

50% deposit taken at time of order.
25% non-refundable deposit upon ordering; 7-day return policy allowance.

– If canceling less than 7 days prior to order date, 50% deposit is taken and non-refundable. Day before pick up, customer is responsible to pay the balance due.
– No checks accepted
– Payments Accepted: Credit Card & Debit Card

ORDERING

– Classic cakes must be ordered 24 hours in advance.
– Semi-Custom cakes must be ordered 2 weeks in advance
– Custom cakes–in house only, must be ordered 2–3 weeks in advance, depending on the cake.

No minimum order amount
Rush fees: $15 rush fee
NOTE: We will try our best to accommodate all requests, but cannot guarantee any last minute availability.

ORDER CHANGES & CANCELLATIONS:

– Classic Cakes: If less than 48 hours or 72 hours cancellation OR date change, lose total amount paid for cake. If greater than 48 hours or 72 hours is given, then they can change date and simply pay appropriate transaction fee.
– Design Changes are not accepted for classic cakes or semi-custom cakes, after initial order.
– Custom Cakes–allowances for design changes 7 days in advance, but must be reasonable (according to pastry chef) and doable.
– Any other changes, will fall under criteria list ed above.

ALTERATIONS

Lido Bakery may need to make an alteration to Customer’s design due to circumstances beyond Lido Bakery’s control which may impact on the quality of the finished cake e.g. weather conditions. Lido Bakery will always inform Custom er if this is the case.

Lido Bakery retains the right to cancel Customer’s order in cases if unusual circumstances beyond Lido Bakery’s control e.g. ill health or fire. In these instances, your deposit will berefunded in full.

SERVING SIZE

– The standard size of each piece of cake has a diameter of 3.5 inch intervals. The cake size isan estimate and not guaranteed to be exact.

– Lido Bakery shall not be held responsible if a cake shortage occurs because cake pieces arecut larger than the agreed uponmeasurements.

CAKES WITH WRITING

– Lido Bakery will write on the cake directly, if there is not decoration and the cake is simple,Lido Bakery will add a plaque if there are embellishments on the cake.

– Cake with a plaque: The plaque will alwaysbe a 2.5” x 2.5” square chocolate plaque. Thecustomer is allowed to order turquoise, pink, or white writing.

– All white cakes with white writing will have the milk chocolate plaque to show the whitecolor of the writing.

LIABILITY

Lido Bakeryis not liable for: damage to cake not caused by Lido Bakery or its employees,property damage, guest injury, harm caused by eating plastic accessories, flower choices(poison, pesticides, dirt, poor handling), post pickup damage, and allergic reactions.Cakes maycontain some non-edible items as part of their design e.g. dowels, ribbons, wires etc. We willalways notify you of non-edible items in your finished cake. It is your responsibility to ensurethat these are removed by your caterer/guests prior to the cake,

SATISFACTION

Lido Bakery strives for complete customer satisfaction. This includes managing customerexpectations and high quality work. However, if Customer is unsatisfied, Lido Bakery will do itsbest to provide a reasonable solution, on a case by case basis, which may include either acustomer credit or a replacement of the cake with one of Lido Bakery’s classic cakes.

INTELLECTUAL PROPERTY

-Due to copyright laws,Lido Bakery’smay not be able to make exact replications, if thedesigns requested are copyrighted.

-Lido Bakery reserves the right to request an Image Copyright Release. Upon Lido Bakery’sand/or its licensors’ request, you agree to defend, indemnify and hold harmless Lido Bakery, itslicensors and affiliates, contractors, vendors, and content providers from all liabilities, claimsand expenses, including attorneys’ fees, that arise from or relate to a breach of this Section forany Customer’s statements of copyright ownership upon which Lido Bakery reasonably relied.

– Lido Bakery may, from time to time, use photos of our cakes in our social media and on ourwebsite. Customer agrees that his or her design may be used in photos or videos on Lidobakery’s website, social media accounts,and promotional material.

– Lido Bakery retains the copyright to all of its cake designs at all times

INFORMATION STORAGE

– We do not store any information other than your name, contact information, and previous order history.

– We utilize Square for all payments. Square is an online payment processing company widely used on the Internet to facilitate sales transactions, including credit card payments. Lido Bakery does not have access to buyers’ credit card numbers or other financial information.

EXCLUSIONS AND LIMITATIONS

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, Lido Bakery excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or Lido Bakery brochures/advertisements; and excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Lido Bakery of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
